Terms & Conditions – Gateway to Galleries
These Terms and Conditions (“Terms”) apply to Gateway to Galleries, including all related videos, online training and learning content, coaching, consulting, and educational resources (collectively referred to as the “Products”).

By purchasing any Products through this site, you agree to these Terms and enter into a legally binding agreement with Sparks Gallery (“Company,” “we,” “us,” or “our”) through gatewaytogalleries.com.

1. Educational Purpose & Disclaimer
All content, advice, training, and materials are provided for informational and educational purposes only and are offered “as is,” without warranties or guarantees of any kind.

While we strive to provide valuable guidance for artists pursuing gallery representation, we make no guarantees regarding specific outcomes, results, sales, or business success. Your implementation of any advice is entirely your responsibility.

To the fullest extent permitted by law, Sparks Gallery shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or implementation of the Products.

2. Access & License
When you purchase access to the Products, you are granted a non-transferable, non-exclusive license to access and use the content for your personal use only.

You may not:

Share, reproduce, distribute, or publish any part of the Products.

Share your login information with others.

Resell, sublicense, or otherwise commercially exploit the Products.

All intellectual property rights remain the sole property of Gateway to Galleries.

3. Refund, Return & Cancellation Policy

When you enroll, you are committing to a minimum of two months in the program, giving you time to implement the training and begin seeing results. If you do not wish to continue after the initial 60-day commitment, you may cancel before your third payment is processed. After the first two months, your membership continues on a month-to-month basis and may be canceled at any time before your next billing date to avoid future charges.

Due to the digital nature of the Products, all sales are final and refunds are not generally offered.

If you believe your situation qualifies as a special circumstance, please contact us at [email protected], and we will review your request at our sole discretion. If a refund is issued, access to the Products will be revoked immediately.

If you are on an annual plan and wish to cancel part way through the year, please email [email protected] for support.

4. Delivery & Access
Purchased Products are delivered digitally and are accessible through your account at gatewaytogalleries.com.

You are responsible for maintaining internet access and compatible devices needed to view the Products.

5. Availability of Services
While we make commercially reasonable efforts to maintain continuous access to the Products, we do not guarantee uninterrupted availability of the website, hosting platform, or video content.

In the event of extended service interruptions, we will make reasonable efforts to restore access or provide alternative delivery options where feasible.

6. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Updated Terms will be posted on our website. Continued use of the Products after changes are made constitutes acceptance of the revised Terms. If you do not agree to updated Terms, your access to the Products may be revoked.

8. Privacy
We take your privacy seriously.

If you opt in to receive updates, we may occasionally email you about related offerings, resources, or program updates. Otherwise, we will only contact you regarding purchases or support related to your Products.

We will never sell or rent your personal information to third parties.

9. Limitation of Liability
By purchasing, you acknowledge that the service provided is educational and advisory in nature. You accept full responsibility for your decisions, actions, and results.

To the maximum extent permitted by law, Sparks Gallery and its representatives will not be liable for any loss or damage arising from your use of the Products.

10. AI-Generated Intake Responses

You agree to complete all intake forms, questionnaires, and discovery materials using your own original responses. Responses generated or substantially drafted by artificial intelligence tools, including but not limited to ChatGPT, Claude, Gemini, or similar large language models, are not permitted. You understand that intake materials are used by Sparks Gallery/Gateway to Galleries to assess brand voice, goals, and other individualized information, and that AI-generated responses may undermine the accuracy and effectiveness of Sparks Gallery/Gateway to Galleries's work.

Prohibition on AI Training Using Deliverables

You agree not to input, upload, or otherwise submit any deliverable provided by Sparks Gallery/Gateway to Galleries into any artificial intelligence system, machine learning model, or automated tool for the purpose of training, fine-tuning, or otherwise developing an AI model. This restriction applies regardless of whether the deliverable has been published or made publicly available. You retain the right to use deliverables as set forth in this Agreement, but ownership of the underlying intellectual property remains with Sparks Gallery/Gateway to Galleries unless otherwise expressly stated, and no license to use Sparks Gallery/Gateway to Galleries’s work for AI training purposes is granted.

 AI Editing of Visual Deliverables

You agree not to use artificial intelligence tools to alter, edit, retouch, stylize, or otherwise modify any photographs, videos, or visual assets delivered by Sparks Gallery/Gateway to Galleries without prior written consent. This includes but is not limited to generative fill, style transfer, AI-powered retouching, background replacement, and image synthesis tools. You understand that modifications made using AI tools may alter the artistic integrity of Sparks Gallery/Gateway to Galleries’s work and may constitute an unauthorized creation of a derivative work.

 Prohibition on AI Use of Sparks Gallery/Gateway to Galleries’s Likeness

You agree not to upload, submit, or otherwise use any photographs, video footage, or other depictions of Sparks Gallery/Gateway to Galleries, whether delivered as part of this Agreement or obtained elsewhere, as inputs into any artificial intelligence image generation, video synthesis, or likeness replication tool. This prohibition applies to promotional materials, social media content, advertisements, and any other use case. Any AI-generated content depicting Sparks Gallery/Gateway to Galleries’s likeness, voice, or appearance, whether realistic or stylized, requires Sparks Gallery/Gateway to Galleries’s separate, express written consent prior to creation or use.

You agree to disclose, prior to project commencement, any known or suspected use of generative AI in the creation of assets they are providing to Sparks Gallery/Gateway to Galleries.

If Sparks Gallery/Gateway to Galleries discovers at any point during or after the project that You made a false or incomplete disclosure regarding AI-generated assets, or that assets submitted by You were generated using AI without disclosure, Sparks Gallery/Gateway to Galleries reserves the right to immediately terminate this Agreement. In the event of termination under this provision, You shall not be entitled to a refund of any deposits or payments made, as Sparks Gallery/Gateway to Galleries’s time, labor, and resources will have been expended in reliance on your representations.

Prohibition on AI Ingestion of Course Materials

Student agrees not to input, upload, copy, or otherwise submit course materials, including but not limited to videos, transcripts, workbooks, templates, scripts, slide decks, and community content, into any artificial intelligence tool for any purpose, including but not limited to generating summaries, creating study guides, producing derivative content, or training or fine-tuning an AI model. Student understand that doing so may constitute a copyright infringement as well as a breach of this contract. "Course materials" includes all content provided by Sparks Gallery/Gateway to Galleries, whether delivered through the course platform, via email, in a community space, or on a live call.

Student agrees not to use any AI-powered notetaking, recording, transcription, or meeting intelligence tool (including but not limited to Otter.ai, Fireflies, Fathom, or similar) on any live group call, coaching call, or community session without prior written consent from Sparks Gallery/Gateway to Galleries. Student understands that live calls may include confidential information, personal disclosures from other participants, and proprietary content from Sparks Gallery/Gateway to Galleries, and that the use of AI notetakers in these spaces is prohibited to protect the privacy and safety of all participants.

Sparks Gallery/Gateway to Galleries may make recordings or AI-generated transcripts available to Students through the course platform at Sparks Gallery/Gateway to Galleries’s discretion. Any such materials are subject to all other restrictions in this Agreement.

Prohibition on Copying or Exporting AI Tools

Where Sparks Gallery/Gateway to Galleries makes AI tools, chatbots, or automated assistants available within the program, Student agrees not to copy, replicate, reverse-engineer, export, or otherwise reproduce those tools outside of the designated platform. Sparks Gallery/Gateway to Galleries’s access to any AI tools provided by Sparks Gallery/Gateway to Galleries is a limited, non-transferable license that exists solely within the scope of the Student's enrollment and terminates upon the conclusion of the program or cancellation of access.

Permitted Use of Creator-Provided AI Tools

Where Sparks Gallery/Gateway to Galleries makes AI tools available within the program, Student may use those tools solely for their own personal educational and business use in connection with the program. Student agrees not to: (a) share access to those tools with third parties; (b) use those tools to generate content that reproduces or substantially replicates Sparks Gallery/Gateway to Galleries’s proprietary materials; or (c) use those tools in any manner inconsistent with the program's terms or the spirit of this Agreement.

Limitation of Liability — AI Tool Outputs

Any AI tools provided by Sparks Gallery/Gateway to Galleries are offered as supplemental resources and do not constitute professional legal, financial, medical, or other licensed advice. Outputs generated by AI tools may contain errors, omissions, or inaccuracies. Sparks Gallery/Gateway to Galleries makes no warranty as to the accuracy or completeness of AI-generated outputs and is not liable for any decisions made in reliance on those outputs.

Disclosure of AI Use in Service Delivery

Sparks Gallery/Gateway to Galleries may use artificial intelligence tools in the delivery of services under this Agreement, including but not limited to research, drafting, ideation, and administrative tasks. Sparks Gallery/Gateway to Galleries represents that all deliverables are reviewed and refined by Sparks Gallery/Gateway to Galleries prior to delivery, and that Sparks Gallery/Gateway to Galleries takes professional responsibility for the final work product regardless of the tools used in its creation.

Data Handling — Provider-Offered AI Tools

Where Sparks Gallery/Gateway to Galleries makes AI tools or automated assistants available to You as part of this Agreement, You acknowledge that inputs submitted to those tools may be processed by third-party AI platforms. Sparks Gallery/Gateway to Galleries will identify the platforms used upon request. Sparks Gallery/Gateway to Galleries is not responsible for the data practices of third-party AI providers, and You are encouraged to review the privacy policies of any such platforms. Sparks Gallery/Gateway to Galleries will not intentionally use Student inputs to train AI models without separate written consent.
